Terms of Service

These Terms of Service govern your access to and use of Picvant at https://picvant.com. By creating an account or using the service, you accept these terms. If you do not agree, please do not use the service.

Picvant is an independent software product operated by Yang Lingtao, an individual based in China. It is not affiliated with, sponsored by or endorsed by Replicate, its routed model providers, or other infrastructure providers.

You may sign up with email, Google or GitHub. You are responsible for keeping your credentials secure and for all activity under your account. You must be at least 18 years old to purchase a subscription or credit pack. Users aged 13–17 outside the EEA, or 16–17 in the EEA, may use non-purchase features only with permission from a parent or legal guardian who accepts these terms. The service is not available to younger children.

Every AI generation consumes credits. New accounts receive 60 welcome credits valid for seven days; paid plans include a monthly allowance and can be topped up with credit packs. Subscriptions are billed through our payment provider on a monthly or yearly cycle, and yearly plans are billed once for the equivalent of ten months.

Failed generations do not consume credits — reserved credits are released automatically. You can manage or cancel your subscription at any time from the billing portal; access continues until the end of the current billing period. Refund eligibility is described in our Refund Policy.

Generation-mode access depends on your current membership: Free accounts can use Draft, Plus members can also use Studio, and Pro members can use Draft, Studio and Ultra. Credit packs add non-expiring credits but do not upgrade or extend membership permissions.

Every prompt and generated result must follow our Acceptable Use Policy. You may not use the service to create or distribute content that:

• is pornographic, sexually explicit, non-consensual or sexually suggestive
• sexualizes or exploits minors, apparent minors or people of ambiguous age
• infringes the intellectual property or privacy rights of others
• manipulates a real person without consent, including face swaps and deceptive deepfakes
• promotes violence, hatred or harassment
• attempts to circumvent safety measures, rate limits or credit accounting

We may suspend accounts that violate these rules, and will cooperate with lawful requests from authorities where required.

You retain any rights you already hold in the prompts you submit. You grant us and the providers selected for your request a limited licence to process them solely to provide, secure and support the requested service. You must have all permissions, releases and consents needed for every prompt and reference image you upload.

To the extent permitted by applicable law and the selected provider terms, you may use generated results for personal or commercial purposes. AI output may not qualify for copyright protection in every jurisdiction, may resemble existing material, and is not guaranteed to be exclusive or non-infringing. Provider terms are disclosed through our policies and provider disclosure. Generation currently uses selected models through Replicate. Picvant does not offer a zero-credit generation model.

The service itself — including its name, interface, code and design — is owned by us and protected by intellectual property law. Nothing in these terms transfers that ownership to you. You may not scrape, resell or rebrand the service without written permission.

The service is provided “as is”. AI generation is probabilistic: results may contain artifacts or inaccuracies, and output quality is not guaranteed for every prompt. We do not warrant that the service will be uninterrupted or error-free.

To the maximum extent permitted by law, our total liability arising from your use of the service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential damages, including lost profits or data.

You may request account closure and deletion by emailing privacy@picvant.com from the address associated with your account. We may ask you to verify ownership before acting. We may suspend or terminate accounts that violate these terms or create risk for other users or the service.

These terms are governed by the laws applicable to the operator in the People’s Republic of China, without depriving consumers of mandatory protections that apply in their country of residence. Before filing a claim, please contact us so we can try to resolve the issue informally. Courts with competent jurisdiction over the operator will have non-exclusive jurisdiction to the extent permitted by law.
